The shortage of organs for transplantation by its nature prompts ethical dilemmas. For example, although there is an imperative to save human life and reduce suffering by maximising the supply of vital organs, there is an equally important obligation to ensure that the process by which we increase the supply respects the rights of all stakeholders. In a relatively unexamined practice in the USA, organs are procured from unrepresented decedents without their express consent. Unrepresented decedents have no known healthcare wishes (...) or advance care planning document; they also lack a surrogate. The Revised Uniform Anatomical Gift Act of 2006 sends a mixed message about the procurement of organs from this patient population and there are hospitals that authorise donation. In addition, in adopting the RUAGA, some states included provisions that clearly allow organ procurement from unrepresented decedents. An important unanswered question is whether this practice meets the canons of ethical permissibility. The current Brief Report presents two principled approaches to the topic as a way of highlighting some of the complexities involved. Concluding remarks offer suggestions for future research and discussion. (shrink)

This essay concerns the disputed nature of the telos in Stoicism and argues that Michel Foucault’s description of the Stoic telos plausibly constitutes an accurate characterization, despite the frequent criticism it has received and the fact that it apparently neglects the important role of nature or physics in Stoicism. To advance this claim, the essay draws upon a neglected set of observations made by Foucault in The Hermeneutics of the Subject, in which the telos is characterized in terms of the (...) elimination of stultitia, or “indecision.” Once we analyze indecision and its causes from the perspective of physics, we can see that indecision is incompatible with the Stoic telos as standardly described, for example as “life in accord with nature.” It can be concluded that the Foucault’s view is not only plausible but is in fact supported by Stoic physics. But unlike Dewey, Arendt seems to bar some activities from admittance to the public sphere on the grounds that they are insufficiently political. These purportedly nonpolitical activities include urgent measures undertaken to alleviate human want, the application of the sciences to human life, andendeavors to free (...) the populous from political life itself. Dewey however selectively allows these activities to be considered political if and when they prove they are not a threat to the plurality, the hallmark of the public realm. Science must accommodate rather than stifle plurality of opinion, political activity must strive toward an end other than freedom from political life, and action must be performed by actors exercising judgment, in accord with principles. In this way, Dewey’s work show us in more concrete detail than Arendt’s, but in the same spirit, how the private sphere can overlap with the political sphere without infiltrating it or robbing it of its distinctness. Traditional pedagogical approaches to the Platonic forms pose problems that can be best addressed by presenting students two rival interpretations: one that understands the forms in terms of definitions, and another in terms of ideals. The second, if not the first interpretation, models, for students of even a relativistic stripe, how one can conceive the existence of thought-objects about which no consensus exists. It also serves to illustrate how knowledge of such thought-objects may be attained nonetheless. Cicero’s De Finibus contains a debate about whether practical knowledge should be compared to theoretical knowledge (theôreia/sapientia), or to technical knowledge (technê/ars). The way in which practical knowledge is conceived by the Stoics on the one hand, and Peripatetics on the other, lies behind and explains, for Cicero, the tendency of Peripatetics to place greater priority upon harmony with the external world, and that of the Stoics to seek inner harmony at the cost of harmony with that external world. The (...) dialogue ends in aporia because, for Cicero, practical knowledge either comes to bear an excessive resemblance to technê, as in the case of the Peripatetics, or to theoretical knowledge, as in the case of the Stoics; for him, it must fall neither to one nor the other extreme. The present essay argues against the view that Santayana’s philosophy can unproblematically be classified as epiphenomenalist. To this end, it examines the central tenets that provide the foundation for his position on metal causation as developed in Scepticism and Animal Faith. This analysis shows that a range of positions are available to Santayana that are compatible with his prohibition on invoking ideas as motor causes, perhaps even demanded by it. While Santayana is consistent in denying that ideas are causes, taken (...) in the usual sense of efficient or motor causes, he does not clearly deny that they are necessary conditions for some behavioral effects. The essay then responds to the objection that we should sooner reject the claim that essences are necessary conditions for action than attempt to argue for the compatibility of this claim with the claim that essences are causally inert. It is argued that Santayana is not alone in considering these assertions compatible, and therefore his position should be classed alongside those of contemporary philosophers who also assert their compatibility. The essay closes by examining some similarities between Santayana’s view and those of contemporary compatibilists. (shrink)

Foucault has been criticized for overlooking the similarities among Platonism, Christianity and Stoicism, and overstating Stoicism’s distinctness. However, an examination of Stoic theories of truth shows that the Stoics sought out a particular kind of knowledge, and that this knowledge was necessarily sought by means of a certain circular process, to which Foucault himself vaguely alludes. This accounts for many of Foucault’s observations, and explains why, even when Stoics speak about such topics as self-knowledge and self-renunciation in ways that recall (...) Platonism and Christianity, their approach is rightly characterized as differing from that of their Platonic and Christian counterparts. Ultimately, this sheds light on Stoicism’s import for politics. In short, only by the Stoic will the search for truth be carried out in such a way that the individual’s identity will neither reinforce, nor be reinforced by his or her grasp of the truth; and this will uniquely prepare the Stoic to enter the political domain and to be recognized there as someone who speaks the truth. Ordinary discourse is filled with discussions about ‘sexual orientation’. This discourse might suggest a common understanding of what sexual orientation is. But even a cursory search turns up vastly differing, conflicting, and sometimes ethically troubling characterizations of sexual orientation. The conceptual jumble surrounding sexual orientation suggests that the topic is overripe for philosophical exploration. This paper lays the groundwork for such an exploration. In it, I offer an account of sexual orientation – called ‘Bidimensional Dispositionalism’ – according to which sexual (...) orientation concerns what sex[es] and gender[s] of persons one is disposed to sexually engage, and makes no reference to one’s own sex and gender. This article is a reexamination of the author’s understanding of pedagogy, aimed at developing an increased awareness of the provinciality, limits and blind spots of the pedagogy and knowledge systems of colonial modernity. It engages with particular Indigenous epistemological theorisations of non-human agency, with Haraway’s notion of multispecies entanglement, and with the Australian Great Barrier Reef in an inquiry aimed at noticing absences and hauntings of pedagogies of modernity, including the absence of ways of knowing and being without separability and (...) determinacy and the damage that has come of this. This opens space for contemplating separability and determinacy as ontological difficulties contributing to socio-ecological crises of our time. The article is intended as a move by the author toward developing greater capacity to stay with the trouble of educating and living on a damaged planet that is fast becoming uninhabitable. (shrink)

In recent years, many school librarians have been scrambling to build and expand their graphic novel collections to meet the large and growing demand for these materials. For the purposes of this study, the term graphic novels refers to volumes in which the content is provided through sequential art, including fiction, nonfiction, and biographical material. As the library field has not yet arrived at a set of best practices or guidelines for institutions working to classify and catalog graphic novels, this (...) study seeks to record the ways in which school librarians are handling these materials as well as issues and questions at the forefront of their minds. A survey of school librarians in the United States revealed that almost all of them collect fiction and nonfiction graphic novels, while 67% collect manga. Most respondents indicated that they are partly or solely responsible for the cataloging and classification decisions made in their media centers. For classification purposes, most have elected to create separate graphic novel collections to house their fictional graphic novels. Some include nonfiction graphic novels in this section, while others create a nonfiction graphic novel collection nearby or shelve nonfiction graphic novels with other items that deal with similar subject matter. Many school librarians express uncertainty about how best to catalog and classify longer series, adapted classics, superhero stories, and the increasing number and variety of inventive titles that defy categorization. They also struggle with inconsistent vendor records and past practices and suffer from a lack of full confidence in their knowledge of how to best classify and catalog graphic novels so that they are both searchable in the library catalog and easily accessible on the shelves. People who inject drugs are often the target of stigma that puts this already at-risk group at greater risk of harm. Past research has shown that holding stigmatizing views of people who inject drugs increases risky behaviors and is a barrier to their engagement in important medical and public health interventions. One explanation is that the negativity surrounding the group causes increased levels of anticipated emotional exhaustion, discouraging positive engagement. However, there has been minimal research focused on addressing this negativity (...) to reduce levels of held stigma against people who inject drugs. We hypothesized that giving people an imagined positive contact exercise about people who inject would lead to a reduction in stigma, since exposure to positive empathy may create new mental associations between stigmatized groups and more positive emotions and experiences. Secondarily, we hypothesized that positive empathy strategies would be more effective than traditional informational or learning based techniques, and that the latter would be more effective than a control condition. Our sample consisted of 375 participants recruited online. Participants were assigned to one of three study conditions: a positive empathy condition, an informational learning condition, or a control condition, and completed a posttest social distance measure. Results demonstrated that subjects exposed to the positive empathy stigma reduction condition experienced a significant reduction in held stigma while participants exposed to traditional informational learning techniques showed no significant reduction in held stigma. Positive empathy-based stigma interventions should be further researched as a promising avenue to reduce the effects of drug-related stigma. (shrink)

We argue that the claim that essence-based causal explanations emerge, hydra-like, from an inherence heuristic is incomplete. No plausible mechanism for the transition from concrete properties, or cues, to essences is provided. Moreover, the fundamental shotgun and storytelling mechanisms of the inherence heuristic are not clearly enough specified to distinguish them, developmentally, from associative or causal networks.

In his posthumously published lectures, Politics in Commercial Society, István Hont argues that Jean-Jacques Rousseau and Adam Smith should be understood as theorists of commercial society. This article challenges Hont’s interpretation of both thinkers and shows that some of his key claims depend on conflating the terms ‘commercial society’ and ‘commercial sociability’. I argue that, for Smith, commercial society should not be defined in terms of the moral psychology of commercial sociability, before questioning Hont’s Epicurean interpretation of Smith’s theory of (...) sociability. I then turn to Rousseau and outline some of the difficulties involved with classifying him as a theorist of commercial society, the most important of which is that he often appeared to be more deeply opposed to commercial progress than Hont suggests. I conclude by highlighting some of the most salient differences between Rousseau’s and Smith’s views of the politics of eighteenth-century Europe. (shrink)

I propose a new concept of solidarity, which I call “solidarity from below,” that highlights an aspect of solidarity widely recognized in popular uses of the term, but which has hitherto been neglected in the philosophical literature. Solidarity from below is the collective ability of otherwise powerless people to organize themselves for transformative social change. I situate this concept with respect to four distinct but intertwined questions that have motivated extant theorizing about solidarity. I explain what it means to conceptualize (...) solidarity from below as a form of power, rather than as a feeling, disposition, duty, or scheme of social arrangements. Finally, I suggest that the moral-relational aspects of solidarity emerge secondarily from the process of collective power, and not the other way around. (shrink)

In this study we analyze the overlapping perspectives of legitimacy theory, institutional theory, resource dependence theory, and stakeholder theory. Our purpose is to explore how these theories can inform and be built upon by one another. Through our analysis we provide a broader theoretical understanding of these theories that may support and promote social and environmental accounting research. This article starts with a detailed analysis of legitimacy theory by bringing some recent critical discussions on legitimacy and corporations in the management (...) literature into accounting research. The notion forwarded by legitimacy theory then serves as an overarching concept to examine the relationship between and among theories. We conclude that two theoretical considerations are important for future social and environmental accounting research. First, it must be acknowledged that some business entities initiate social activities based on direct interactions with stakeholders, whereas others may also undertake similar activities to manage their societal level of legitimacy. Second, from analyzing the perspectives of legitimacy theory, institutional theory, resource dependence theory, and stakeholder theory, it is possible to reach compatible interpretations of business social phenomena, and the selection and application of these theories should depend upon the focus of study. The debate over the political power of business has witnessed a revival after the global financial crisis of 2007—2009. We begin by arguing that business political fragmentation or unity has important consequences for policy outcomes. The structure of the U.S. government is conducive to incremental policy changes, often in response to business pressures. In turn, these changes shape the political interests and alliances of business. We illustrate this dynamic through an analysis of the political processes leading to the enactment of (...) the Financial Modernization Act of 1999, which repealed Depression-era regulations and allowed commercial banks to enter the securities and insurance business and vice versa. The FMA condoned the emergence of largely unregulated diversified financial institutions, which proved “too big to fail” during the crisis. Several factors contributed to the FMA: political institutions, international competition, the ideological convergence of the Republican and Democratic parties, and the political interests of financial industry actors. In this paper, I critically reconstruct the development of Merleau-Pontyan phenomenology and “radical embodied cognitive science” out of Berlin-School Gestalt theory. I first lay out the basic principles of Gestalt theory and then identify two ways of revising that theory: one route, followed by enactivism and ecological psychology, borrows Gestaltist resources to defend a pragmatic ontology. I argue, however, that Merleau-Ponty never endorses this kind of ontology. Instead, I track his second route toward an ontology of “flesh.” I show how (...) Merleau-Ponty’s arguments for this ontology depend upon criticisms of Gestalt Psychology to which radical embodied cognitive science remains vulnerable, and show that it leads him to a romantic philosophy of nature. The dominant thought in Greek cosmology, Collingwood holds, was the microcosm-macrocosm analogy, nature being the substance of something ensouled where "soul" meant the self-moving. Part II is "The Renaissance View of Nature." Collingwood describes the (...) rise and decline of the deists' view of Nature as a machine designed by the Great Contriver who, having turned it out, watches it go. Part III, "The Modern View of Nature," deals with very recent or contemporary philosophy and science, discerning in it a radical evolutionism first in biology and later in cosmology. The attempts to mitigate the unprecedented health, economic, and social disruptions caused by the COVID-19 pandemic are largely dependent on establishing compliance to behavioral guidelines and rules that reduce the risk of infection. Here, by conducting an online survey that tested participants’ knowledge about the disease and measured demographic, attitudinal, and cognitive variables, we identify predictors of self-reported social distancing and hygiene behavior. To investigate the cognitive processes underlying health-prevention behavior in the pandemic, we co-opted the dual-process model of thinking (...) to measure participants’ propensities for automatic and intuitive thinking vs. controlled and reflective thinking. Self-reports of 17 precautionary behaviors, including regular hand washing, social distancing, and wearing a face mask, served as a dependent measure. The results of hierarchical regressions showed that age, risk-taking propensity, and concern about the pandemic predicted adoption of precautionary behavior. Variance in cognitive processes also predicted precautionary behavior: participants with higher scores for controlled thinking (measured with the Cognitive Reflection Test) reported less adherence to specific guidelines, as did respondents with a poor understanding of the infection and transmission mechanism of the COVID-19 virus. The predictive power of this model was comparable to an approach (Theory of Planned Behavior) based on attitudes to health behavior. Given these results, we propose the inclusion of measures of cognitive reflection and mental model variables in predictive models of compliance, and future studies of precautionary behavior to establish how cognitive variables are linked with people’s information processing and social norms. Using testosterone alone as a measure of dominance presents problems, especially when dominance is loosely defined to include a range of behaviors that may arise from multiple causes. Testosterone should be examined in relation to other hormonal and neurotransmitter factors, such as serotonin. Various hypotheses about the relationship between high and low levels of testosterone with serotonin and with impulse control are suggested for future study.

Comparative ethics raises theoretical and methodological problems important for all ethical studies. Five essays in this focus section provide introductions to the ethics of specific indigenous cultures and suggest implications for further comparative studies. In this introduction, we review these findings and discuss their relevance to the concept of ethical naturalism which we have previously offered as a basis for comparative work.

This thesis examines the nature of the supplementary relationship between Husserlian phenomenology and deconstruction. Chapter 1 gives an account of the strategies and aims of deconstruction, determining these to be an attempt to respond, using ‘other names’, to the other which is excluded by phenomenology/philosophy in its attempts to master its own limits. In Chapter 2, it is found that alterity is encountered by phenomenology on its own thresholds, informing the genetic turn in phenomenology which is necessitated as a result (...) of the inquiries into the temporal constitution which founds the possibility of an object’s being given as such to consciousness. Furthermore, it is shown how the possibility of the genetic turn resides in the indication relation examined in the phenomenology of signification. Chapter 3 focusses on the deconstruction of phenomenology, and investigates the double movement in phenomenology which the deconstruction reveals, taking time and language as guiding threads. On the one hand, the genetic turn appears to reveal a founding alterity, which, on the other hand, phenomenology strives to suppress in accordance with its adherence to its own ‘principle of principles’. It is argued that the deconstruction aims to accord phenomenological respect to the alterity uncovered by phenomenological descriptions. This is done through thematising certain operative concepts, concepts which remain unthemtised in phenomenology precisely because such thematisation would reveal a founding non-presence intolerable to phenomenology. Deconstruction supplements phenomenology to the extent that it attempts to name, on the fissured margins of phenomenology, the radical alterity uncovered by phenomenology in a way which does not reduce the very otherness of the alterity. However, in the final Chapter, it is argued, from the perspective of Levinas, that Derrida does not in fact manage to find a sense for founding alterity in phenomenology which is ‘beyond metaphysics’. The thesis concludes by arguing that, in order to achieve its strategic aims, as detailed in Chapter 1, the deconstruction of phenomenology needs to be ethically supplemenred, one example of such an ethically supplemented deconstructive reading of Husserl being found in some of the most recent texts of Levinas. Low levels of public trust in data practices have led to growing calls for changes to data-driven systems, and in the EU, the General Data Protection Regulation provides a legal motivation for such changes. Data management is a vital component of data-driven systems, but what constitutes ‘good’ data management is not straightforward. Academic attention is turning to the question of what ‘good data’ might look like more generally, but public views are absent from these debates. This paper addresses this gap, (...) reporting on a survey of the public on their views of data management approaches, undertaken by the authors and administered in the UK, where departure from the EU makes future data legislation uncertain. The survey found that respondents dislike the current approach in which commercial organizations control their personal data and prefer approaches that give them control over their data, that include oversight from regulatory bodies or that enable them to opt out of data gathering. Variations of data trusts – that is, structures that provide independent stewardship of data – were also preferable to the current approach, but not as widely preferred as control, oversight and opt out options. These features therefore constitute ‘good data management’ for survey respondents. These findings align only in part with principles of good data identified by policy experts and researchers. Our findings nuance understandings of good data as a concept and of good data management as a practice and point to where further research and policy action are needed. (shrink)

It is an honor to participate in this commemoration of the centenary of the death of Josiah Royce. The commemoration provides an occasion for revisiting and reinterpreting Royce to find his continued significance. Once relegated to the margins of American philosophy, a growing group of scholars has been turning to Royce in recent years. This article critiques certain notions of a learning society. These are framed largely in economic and humanist frameworks of competitiveness and social exclusion. This overlooks the implications of information, communications and media technologies, and the linguistic turn in social theory. These suggest a learning society can be framed as a 'society of signs'. Some of the possible implications of the latter are outlined.

A challenge of performing research in the paediatric emergency and acute care setting is obtaining valid prospective informed consent from parents. The ethical issues are complex, and it is important to consider the perspective of participants, health care workers and researchers on research without prospective informed consent while planning this type of research. We performed a systematic review according to PRISMA guidelines, of empirical evidence relating to the process, experiences and acceptability of alternatives to prospective informed consent, in the paediatric (...) emergency or acute care setting. Major medical databases and grey sources were searched and results were screened and assessed against eligibility criteria by 2 authors, and full text articles of relevant studies obtained. Data were extracted onto data collection forms and imported into data management software for analysis. Thirteen studies were included in the review consisting of nine full text articles and four abstracts. Given the heterogeneity of the methods, results could not be quantitatively combined for meta-analysis, and qualitative results are presented in narrative form, according to themes identified from the data. Major themes include capacity of parents to provide informed consent, feasibility of informed consent, support for alternatives to informed consent, process issues, modified consent process, child death, and community consultation. Our review demonstrated that children, their families, and health care staff recognise the requirement for research without prior consent, and are generally supportive of enrolling children in such research with the provisions of limiting risk, and informing parents as soon as possible. Australian data and perspectives of children are lacking and represent important knowledge gaps. (shrink)
